DBS Privacy Notice
Hampshire County Council collects information about you in order to carry out employment checks. These checks may include right to work in the UK checks, reference checking and Disclosure & Barring Service checks where these are required. We complete these checks to comply with the County Council’s legal obligations as an employer and on behalf of our partners as employers. These checks also ensure that only suitable people are employed to work for all employers and in particular with vulnerable groups.
The legal basis for our use of this information is that checks are necessary for the performance of an employment contract. We also process this information to comply with legal obligations where checks are required for safeguarding purposes and to comply with right to work in the UK requirements. Some personal data collected will include special category personal data and where this is the case the legal bases for using the information will be employment and substantial public interest.
Your information will be shared with our supplier Cantium Business Solutions who are contracted to provide an employment check service to us.
As part of the employment check service, your personal data, including some special category data, may be shared with Yoti Ltd (a subcontractor of Cantium Business Solutions) for the performance of an online identity check. Yoti Ltd is an approved digital identity service provider (IDSP). If you do not or are unable to proceed with the online identity check, you will be required to provide evidence of your identity documents in-person (suitable documents can be found on the DBS ID checking guidance pages).
We may also need to undertake an external ID check via Experian, who are also a subcontractor of Cantium.
If your information is shared with Yoti in relation to identity checking, the information will be processed in the UK and may also be processed in India. Standard contractual clauses and the UK Addendum are in place to protect the data transfer.
We will share your information with the DBS to process the application and those involved in the recruitment or vetting processes where required. Dependent on the outcome of the DBS check, further actions and decisions may be required by the manager regarding suitability to work with vulnerable groups and children.
Applications will be archived if:
1. The application has not been completed by the applicant, 6 months after the check was initiated.
2. The applicant’s identity has not been verified by the ID verifier, within 3 months of the applicant completing their section of the application form.
3. A result was received, and the disclosure issue date was 6 months ago.
Once an application is archived, personal data will be held on the EmploymentCheck system for 6 months and then purged, remaining non-personal data is kept for 6 years.
